The immediate protection of Deferred ACTION provided by DACA and DAPA to undocumented immigrants is limited in scope to only three years. But even though the protection provided by DACA and DAPA is limited to Deferred Action, there may be other potential benefits for undocumented immigrants who apply for protection at this time. The last few times the U.S. Congress has enacted comprehensive immigration reform legislation, the right of undocumented immigrants to obtain legal status in the U.S. has been tied to their ability to prove their presence in the country for a prior period of time. It is very likely that future immigration legislation will follow a similar pattern. If so, by coming forward now and applying under either DACA or DAPA, you may be establishing your right to subsequent relief and protection if and when Congress does enact comprehensive reform. This is a major reason for undocumented immigrants to come forward and apply for eligibility under DACA and DAPA now.
